La ARCA simplifica el régimen de conservación, digitalización y eliminación de la documentación aduanera
El 24 de septiembre de 2026 se publicó en el Boletín Oficial y entró en vigencia la Resolución General N° 5900/2026 (la “Resolución”), por medio de la cual la Agencia de Recaudación y Control Aduanero (la “ARCA”) modifica el régimen operativo aplicable al archivo, digitalización, desafectación y destrucción de la documentación aduanera en resguardo de los declarantes bajo la figura de depositario fiel (modificando las Resoluciones Generales N° 2.721 y 3.069).
A continuación, destacamos los puntos fundamentales de la Resolución:
- Plazo de conservación: Se establece que el declarante en su carácter de depositario fiel (sea por auto-archivo o mediante un Prestador de Servicios de Archivo y Digitalización - PSAD) deberá conservar la documentación aduanera hasta el momento en que opere la prescripción de la acción del Fisco correspondiente a la destinación u operación aduanera de que se trate.
- Libre disposición y destrucción sin veedores: Finalizado el plazo de prescripción, el depositario fiel podrá disponer libremente de la documentación y proceder a su destrucción por el método que estime conveniente bajo su exclusiva responsabilidad, sin necesidad de requerir autorización previa, efectuar notificaciones ni contar con la presencia de veedores de la aduana (excepto cuando exista un procedimiento administrativo o judicial en curso).
- Régimen de auto-archivo e inhabilitaciones: Se adecua el procedimiento para la inhabilitación y rehabilitación del uso de la modalidad de auto-archivo en el Sistema Informático Malvina ante incumplimientos de plazos o de condiciones físico-ambientales y tecnológicas, estableciendo un mecanismo de intimación previa de 10 días hábiles vía SICNEA para subsanar los incumplimientos o presentar descargo.
- Abrogación de normativa previa: Se abrogan las Resoluciones Generales Nros. 2.864, 4.476, 4.654 y 5.043, eliminando los trámites y exigencias formales precedentes para la desafectación final de legajos.
- Vigencia e implementación: Entra en vigencia a partir del día de su publicación en el Boletín Oficial (24 de septiembre de 2026) y su implementación progresiva se efectuará conforme al cronograma que estará disponible en el micrositio “Depositario Fiel” del sitio web de ARCA.

ARCA simplifies the regime for conservation, digitization, and disposal of customs documentation
On September 24, 2026, General Resolution No. 5900/2026 (the “Resolution”) was published in the Official Gazette and entered into force, by means of which the Tax Collection and Customs Control Agency (“ARCA”) amends the operational regime applicable to the archiving, digitization, decommissioning, and destruction of customs documentation safeguarded by declarants acting as faithful custodians (amending General Resolutions Nos. 2,721 and 3,069).
Below, we highlight the main key points of the Resolution:
- Retention period: It is established that the declarant, acting as a faithful custodian (whether through self-archiving or via an Archiving and Digitization Service Provider - PSAD), must retain customs documentation until the statute of limitations for Tax Authority action regarding the corresponding customs destination or operation expires.
- Free disposal and destruction without inspectors: Once the limitation period has lapsed, the faithful custodian may freely dispose of the documentation and proceed to destroy it using any method deemed suitable under their sole responsibility, without needing prior authorization, notifications, or the presence of customs inspectors (except when an ongoing administrative or judicial proceeding exists).
- Self-archiving regime and disqualifications: The procedure for disqualification and reinstatement of the self-archiving method within the Malvina Information System is adapted for non-compliance with deadlines or physical, environmental, and technological conditions, establishing a 10-business-day prior notice mechanism via SICNEA to remedy non-compliance or submit defense arguments.
- Abrogation of prior regulations: General Resolutions Nos. 2,864, 4,476, 4,654, and 5,043 are abrogated, eliminating previous formal procedures and requirements for the final decommissioning of files.
- Effective date and implementation: It enters into force on the day of its publication in the Official Gazette (September 24, 2026), and its progressive implementation will be carried out according to the schedule available on the “Depositario Fiel” microsite of the ARCA website.
