La Superintendencia de Seguros de la Nación reglamenta la aplicación de metodologías alternativas para el cálculo de siniestros pendientes de reporte
El 29 de julio de 2026 se publicó en el Boletín Oficial la Resolución Nº 325/2026 (la “Resolución”), mediante la cual la Superintendencia de Seguros de la Nación (la “SSN”) faculta a las entidades a implementar metodologías cuantitativas propias para el cálculo de Siniestros Ocurridos y No Reportados (“IBNR”).
Entre los aspectos más relevantes de la Resolución se destacan:
- Solicitud y oportunidad: Las aseguradoras podrán presentar una metodología alternativa para IBNR en cualquier rama o cobertura únicamente al cierre de cada ejercicio económico financiero anual (a partir del 30/06/2026). La SSN podrá objetar el modelo en cualquier etapa del proceso de supervisión; ante dicha objeción, la entidad deberá volver al método general. Se excluye expresamente de esta facultad a las entidades bajo medidas cautelares.
- Test de Suficiencia: Se establece la acreditación obligatoria con periodicidad semestral (30 de junio y 31 de diciembre) para demostrar que la estimación alternativa resulta suficiente. La Resolución define la fórmula actuarial de cálculo ajustada por índices de precios (FACPCE Res. 539/18) y tasa pasiva BCRA 14.290.
- Esquema de amortización de diferencias: Las entidades que ingresen al régimen amortizarán en un plazo de dos años la menor reserva resultante frente a la metodología del Reglamento General de la Actividad Aseguradora (RGAA). En cada cierre semestral se recalculará el saldo computable aplicándole una escala decreciente (100%, 75%, 50% y 25%).
- Restricción de utilidades: Mientras la cuenta de amortización mantenga saldo registrado, se prohíbe la distribución de dividendos o remesas de utilidades, y las cooperativas, mutuales u organismos oficiales deberán capitalizar sus excedentes o destinarlos a fondos de garantía/capital.
- Régimen de desafectación gradual: Si el test de suficiencia es positivo, el porcentaje de desafectación computable sobre la diferencia de reserva se incrementa en un 25% respecto del semestre anterior (hasta 100%). Si es negativo, se reduce en un 25% (hasta 0%). Registrar cuatro resultados negativos consecutivos en el test implica la pérdida automática de la facultad de usar el método alternativo por un año.
- Informes e intervención actuarial externa: Se establece la exigencia de presentar junto con los estados contables un Informe Circunstanciado y un Informe Técnico dictaminado por actuario externo inscripto en la SSN. El actuario deberá mantener a disposición de la SSN la totalidad de los papeles de trabajo analíticos utilizados.
La Resolución representa una flexibilización regulatoria hacia modelos actuariales a medida y basados en gestión propia de cartera, al tiempo que impone una estricta tutela patrimonial a través del régimen sancionatorio de desafectación y la prohibición de repartir utilidades mientras subsistan diferimientos contables.

The National Superintendence of Insurance regulates the application of alternative methodologies for the calculation of unreported claims
On July 29, 2026, Resolution No. 325/2026 (the “Resolution”) was published in the Official Gazette, by means of which the National Superintendence of Insurance (the “SSN”) authorizes entities to implement their own quantitative methodologies for the calculation of Incurred But Not Reported (“IBNR”) claims.
The most relevant aspects of the Resolution are:
- Request and timing: Insurers may present an alternative methodology for IBNR in any branch or coverage only at the close of each annual financial year (starting June 30, 2026). The SSN may object to the model at any stage of the supervision process; in the event of such an objection, the entity must return to the general method. Entities under precautionary measures are expressly excluded from this authorization.
- Sufficiency Test: Mandatory accreditation is established on a semi-annual basis (June 30 and December 31) to demonstrate that the alternative estimate is sufficient. The Resolution defines the actuarial calculation formula adjusted by price indices (FACPCE Res. 539/18) and BCRA 14.290 passive rate.
- Amortization scheme for differences: Entities that join the regime will amortize the lower reserve resulting from the methodology of the General Regulation of Insurance Activity (RGAA) over a period of two years. At each semi-annual closing, the computable balance will be recalculated by applying a decreasing scale (100%, 75%, 50%, and 25%).
- Profit restriction: As long as the amortization account maintains a recorded balance, the distribution of dividends or remittance of profits is prohibited, and cooperatives, mutuals, or official agencies must capitalize their surpluses or allocate them to guarantee/capital funds.
- Gradual release regime: If the sufficiency test is positive, the percentage of computable release on the reserve difference increases by 25% compared to the previous semester (up to 100%). If it is negative, it is reduced by 25% (up to 0%). Recording four consecutive negative results in the test implies the automatic loss of the right to use the alternative method for one year.
- Reports and external actuarial intervention: It is required to present, together with the financial statements, a Detailed Report and a Technical Report signed by an external actuary registered with the SSN. The actuary must keep all analytical working papers used available to the SSN.
The Resolution represents a regulatory relaxation towards customized actuarial models based on self-management of the portfolio, while imposing strict equity protection through the sanctioning regime of release and the prohibition of profit distribution as long as accounting deferrals subsist.
