La CNV modifica el régimen de prevención del lavado de activos, la financiación del terrorismo y de la proliferación de armas

Por medio de la Resolución N° 1139/2026 (la “Resolución”), vigente desde el 15 de mayo de 2026, la Comisión Nacional de Valores (la “CNV”) simplifica las disposiciones del Título XI de las Normas de la CNV (Normas N.T. 2013 y mod.) correspondiente a la prevención del lavado de activos, la financiación del terrorismo y de la proliferación de armas de destrucción masiva (PLA/FT/FP).


Los principales puntos de la Resolución son los siguientes:

  • Previsibilidad y armonización: La Resolución unifica criterios regulatorios operativos entre los distintos regímenes y segmentos de inversión con el objetivo de otorgar seguridad jurídica tanto a emisores como a inversores. 
  • Modalidad de pago: Se modifican los medios de pago permitidos para los Sujetos Obligados del mercado de capitales (artículos 7 y 8 de la Ley N° 25.246). Se elimina la posibilidad de utilizar efectivo -exceptuando a aquellos que hayan adherido al Régimen de Declaración Jurada Simplificada de Ganancias- y se incorpora la utilización del cheque electrónico.
  • Nuevas obligaciones informativas: Se incorporan obligaciones adicionales sobre el requerimiento de información vinculada a Beneficiarios Finales, la segmentación de clientes basada en riesgo y la condición de Persona Expuesta Políticamente (PEP).
  • Activos Virtuales: Las modificaciones relativas a los medios de pago y al cumplimiento del Régimen Informativo se extienden explícitamente a los Proveedores de Servicios de Activos Virtuales (PSAV).

CNV amends the compliance framework for the prevention of money laundering, terrorist financing, and the proliferation of weapons

On May 15, 2026, General Resolution No. 1139/2026 (the “Resolution”) of the National Securities Commission (“CNV”) entered into force. Through this Resolution, the CNV streamlines the provisions of Title XI of the CNV Rules (Rules N.T. 2013, as amended) regarding the prevention of money laundering, terrorist financing, and the proliferation of weapons of mass destruction (AML/CFT/CPF).


The core provisions of the Resolution include:

  • Predictability and harmonization: The Resolution unifies operational regulatory standards across different investment regimes and segments to provide legal certainty for both issuers and investors.
  • Payment methods: Permissible payment methods for capital market Regulated Entities (under Sections 7 and 8 of Law No. 25,246) have been amended. The use of cash is eliminated —except for entities that have opted into the Simplified Income Tax Return System— while the use of electronic checks (e-checks) is formally incorporated.
  • Additional reporting mandates: New compliance requirements are introduced regarding the disclosure of information on Beneficial Owners, risk-based customer segmentation, and Politically Exposed Person (PEP) status.
  • Virtual Assets: The amendments regarding payment methods and Reporting Framework duties are explicitly extended to Virtual Asset Service Providers (VASPs).
