Normas complementarias dictadas en relación al Decreto de Necesidad y Urgencia N° 438/2023

Recordamos que mediante el Decreto de Necesidad y Urgencia N° 438/2023 (el “DNU”) se estableció el pago de una asignación no remunerativa para los trabajadores en relación de dependencia del sector privado, público y de casas particulares. Con posterioridad, se dictaron las siguientes normas complementarias y aclaratorias:

  1. La Resolución N° 1125/2023 del Ministerio de Trabajo, Empleo y Seguridad Social (el “Ministerio”) (publicada en el Boletín Oficial el 1 de septiembre de 2023) que aclara que a los fines de determinar los sujetos alcanzados por el DNU, debe entenderse por salario neto el importe que surge de deducir del salario bruto los aportes personales que corresponden al Sistema Integrado Previsional Argentino (SIPA) (Ley N° 24.241), al Instituto Nacional de Servicios Sociales para Jubilados y Pensionados (Ley N° 19.032) y al Régimen Nacional de Obras Sociales (Ley Nº 23.660). Por otra parte se estableció que se encuentran alcanzados por la asignación no remunerativa establecida en el DNU, los trabajadores cuyas relaciones laborales se encuentren declaradas al 31 de agosto de 2023. Asimismo establece que el monto de la asignación se calculará sobre los salarios devengados de agosto de 2023.
  2. La Resolución N° 1133/2023 del Ministerio (publicada en el Boletín Oficial el 5 de septiembre de 2023) que aclaró que la absorción de la asignación no remunerativa prevista en el DNU podrá ser efectivizada siempre y cuando se haya previsto en los Acuerdos o Convenios Colectivos de trabajo ya pactados para las remuneraciones devengadas en los meses de agosto y septiembre de 2023. De lo contrario, los aumentos salariales ya pactados no podrán ser absorbidos.
  3. La Resolución N° 1136/2023 del Ministerio (publicada en el Boletín Oficial el 6 de septiembre de 2023) estableció que los empleadores del “Régimen de Contrato de Trabajo para el Personal de Casas Particulares” que no estuvieron alcanzados por el impuesto sobre los bienes personales en el ejercicio fiscal 2022, que hayan percibido ingresos netos en el mes agosto de 2023 por un monto inferior a $ 1.500.000, que no se encuentren en el Registro de Empleadores con Sanciones Laborales (REPSAL), y que hubieren abonado la asignación no remunerativa prevista en el DNU, podrán solicitar el reintegro de hasta el 50% de la asignación no remunerativa abonada, previo cumplimiento de determinados requisitos.

Supplementary regulations in connection with the Decree of Necessity and Urgency No. 438/2023

By means of Decree of Necessity and Urgency No. 438/2023 (the “Decree”), the payment of a non-remunerative allowance for employees in the private, public and private homes sectors was established. Subsequently, the following complementary and clarifying regulations were issued:

  1. Resolution No. 1125/2023 of the Ministry of Labour, Employment and Social Security (the “Ministry”) (published in the Official Gazette on September 1, 2023) which clarifies that for the purposes of determining the subjects reached by the Decree, net salary should be understood as the amount resulting from deducting from the gross salary the personal contributions corresponding to the Argentine Integrated Pension System (SIPA) (Law No. 24,241), to the National Institute of Social Services for Retirees and Pensioners (Law No. 19,032) and to the National System of Social Works (Law No. 23,660). Additionally, it was established that the non-remunerative allowance established in the Decree is applicable to workers whose labor relations are declared as of August 31, 2023. It also establishes that the amount of the allowance will be calculated on the wages accrued as of August 2023.
  2. Resolution No. 1133/2023 of the Ministry (published in the Official Gazette on September 5, 2023) clarified that the absorption of the non-remunerative allowance provided for in the Decree may be made effective as long as it has been provided for in the Collective Labour Agreements already agreed for the remunerations accrued in the months of August and September 2023. Otherwise, the salary increases already agreed may not be absorbed.
  3. Resolution No. 1136/2023 of the Ministry (published in the Official Gazette on September 6, 2023) established that the employers of employees of private houses (“Régimen de Contrato de Trabajo para el Personal de Casas Particulares”) who were not subject to personal property tax in fiscal year 2022, who have received net income in the month of August 2023 for an amount lower than AR$ 1,500,000, who are not in the Register of Employers with Labour Penalties (REPSAL, after its Spanish acronym), and who have paid the non-remunerative allowance provided for in the Decree, may request the reimbursement of up to 50% of the non-remunerative allowance paid, subject to compliance with certain requirements.
