La Corte Suprema de Justicia de la Nación dejó sin efecto la medida cautelar que había suspendido la derogación de la ley de tierras rurales
La Corte Suprema de Justicia de la Nación (“CSJN”) resolvió rechazar una acción de amparo y revocar una medida cautelar que había suspendido la derogación de la Ley de Tierras Rurales dispuesta por el Presidente Milei en el artículo 154 del Decreto de Necesidad y Urgencia Nº 70/2023.
Para así decidir, la CSJN consideró que la parte actora de esa acción de amparo no tenía legitimación para cuestionar la Ley de Tierras Rurales y que tampoco existía un “caso” concreto que los tribunales pudieran resolver.
Por ende, el efecto del fallo de la CSJN es que el artículo 154 del DNU Nº 70/2023 recobra vigencia y con ello también la derogación de la Ley de Tierras Rurales. En consecuencia, a la fecha, no existen restricciones -a nivel nacional- para la compra de tierras rurales por extranjeros (salvo por el régimen de Zonas de Seguridad de Fronteras, en la medida que sea aplicable).
Finalmente, la CSJN aclaró que su pronunciamiento no supone abrir juicio sobre la validez constitucional del artículo 154 del DNU Nº 70/2023 ni implica interferencia alguna sobre la intervención del Poder Legislativo contemplada en el artículo 99, inciso 3, de la Constitución Nacional respecto de la mencionada norma.

The National Supreme Court of Justice set aside the injunction that had suspended the repeal of the rural land law
The National Supreme Court of Justice (“CSJN”) ruled to dismiss an amparo action (a constitutional protection lawsuit) and overturn an injunction that had suspended the repeal of the Rural Land Law—a measure ordered by President Milei in Article 154 of Necessity and Urgency Decree No. 70/2023.
In reaching this decision, the CSJN held that the plaintiff in the amparo action lacked standing to challenge the Rural Land Law and that there was no concrete “case or controversy” for the courts to resolve.
Consequently, the effect of the CSJN ruling is that Article 154 of Decree No. 70/2023—and thus the repeal of the Rural Land Law—comes back into force. As a result, there are currently no national-level restrictions on the purchase of rural land by foreigners (except for the Border Security Zone regime, to the extent applicable).
Finally, the CSJN clarified that its ruling does not constitute a judgment on the constitutional validity of Article 154 of Decree No. 70/2023, nor does it interfere with the role of the Legislative Branch as set forth in Article 99, Section 3, of the National Constitution regarding the measure in question.
