Reglamentación del artículo 179 de la Ley de Contrato de Trabajo. Salas maternales y guarderías

El 23 de marzo de 2022 se publicó en el Boletín Oficial el Decreto N° 144/2022 (el “Decreto”), por el que, en cumplimiento de lo dispuesto por la Corte Suprema de Justicia de la Nación, se reglamenta y como tal se hace operativo el artículo 179 de la Ley de Contrato de Trabajo que dispone la obligación de los empleadores de “habilitar salas maternales y guarderías para niños…”.

El Decreto establece una vacancia de un año para tornarse operativo, por lo que será exigible a partir del 23 de marzo de 2023.

El Decreto obliga a ofrecer espacios de cuidado de niños entre 45 días y 3 años de edad, en los establecimientos con 100 o más trabajadores. A los efectos del cómputo, se cuentan a los dependientes de otras empresas que presten servicios tercerizados y a los teletrabajadores.

Asimismo, se establece que los espacios de cuidado deberán respetar las condiciones de habilitación de cada jurisdicción; pero se autoriza a cumplir la obligación a) mediante consorcios con otras empresas, en la medida que el espacio de cuidado se establezca en un radio de 2 kilómetros del establecimiento; b) contratando servicios en una guardería externa; y c) si por negociación colectiva se prevé el pago de una suma No Remunerativa, en concepto de reintegro de gastos, debidamente documentado, el cual no podrá ser inferior al 40% del salario mensual de la categoría “Asistencia y Cuidados de Personas” del Personal con retiro del régimen previsto en la Ley de contrato de trabajo para personal de casas particulares (Ley N° 26.844), o al monto efectivamente gastado en caso de que este sea menor. Para el caso de los teletrabajadores, esta forma de cumplimiento es operativa sin necesidad de que sea acordada en negociación colectiva.

Por último, se establece que incumplimiento al régimen implicará calificar la conducta como un incumplimiento MUY Grave, que puede implicar una multa del 50% al 2000% del valor mensual del Salario Mínimo, Vital y Móvil vigente al momento de la constatación de la infracción, por cada trabajador afectado.

Section 179 of Law on Employment Contract is regulated. Maternal rooms and nurseries

On March 23, 2022, Decree No. 144/2022 (the “Decree”) was published in the Official Gazette. In compliance with the provisions of the Supreme Court of Justice, by means of the Decree, the Executive Branch regulates Section 179 of the Labor Contract Law, which establishes the obligation of employers to “enable maternity rooms and nurseries for children…”, making it operational.

The dispositions of the Decree will be required as of March 23, 2023.

The Decree requires that establishments with 100 or more workers offer childcare spaces for children between 45 days and 3 years of age. For computation purposes, employees of other companies that provide outsourced services as well as teleworkers have to be considered.

Likewise, the Decree establishes that care spaces must respect the conditions of each jurisdiction for its authorization; but the obligation may be fulfilled a) through consortiums with other companies, to the extent that the care space is established within a radius of 2 kilometers from the establishments; b) contracting services in an external nursery; and c) if by collective agreement the payment of a Non-Remunerative amount is stipulated, as a way of reimbursement of expenses, duly documented, which may not be less than 40% of the monthly salary of the category “Assistance and Care of Persons” of Personnel who do not live in the place where they perform their tasks from the regime provided for in the Employment Contract Law for personnel of private homes (Law No. 26,844), or the amount actually spent, in case it is less. In the case of teleworkers, this method of compliance is operational without the need for it to be agreed upon in collective agreement.

Finally, it is established that non-compliance with this regime will imply qualifying the conduct as a VERY Serious breach, which may imply a fine of 50% to 2000% of the monthly value of the minimum wage (Salario mínimo, vital y móvil) in force at the time of the verification of the infraction, for each affected worker.
